Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Ironclad Claims Division portal (the "Portal") operated by Ironclad Claims Division, a division of Ironclad Equity & Assets Group, Inc. ("Company," "we," "us," or "our"). By accessing the Portal or submitting a claim, you agree to be bound by these Terms. If you do not agree, do not use the Portal.
2. Nature of Services
Ironclad Claims Division provides unclaimed property recovery services. We identify unclaimed property held by the California State Controller's Office (SCO) and other state agencies, locate the rightful owners, and assist them in filing claims to recover their property.
You are under no obligation to use our services. You may file a claim directly with the California State Controller's Office at no cost by visiting sco.ca.gov. Our services are offered as a convenience for those who prefer professional assistance with the claims process.
3. Finder's Fee Agreement
By signing the Standard Investigator Agreement through the Portal, you agree to pay Ironclad Claims Division a finder's fee equal to ten percent (10%) of the gross amount of unclaimed property recovered on your behalf. This fee is:
- Contingent upon successful recovery of your property — no fee is charged if the claim is unsuccessful.
- Deducted from the recovered amount before disbursement to you, or invoiced separately as agreed.
- Governed by California Business and Professions Code Section 21200 et seq., which limits finder's fees for unclaimed property to no more than ten percent (10%) of the recovered amount.
You will receive no less than ninety percent (90%) of the gross recovered amount. The Standard Investigator Agreement, once signed, constitutes a binding contract between you and Ironclad Claims Division.
4. Scope of Services
Our services include:
- Identification and verification of unclaimed property in your name.
- Preparation and submission of claim documentation to the relevant state agency.
- Communication with the SCO or other agencies on your behalf during the claims process.
- Status updates throughout the review and disbursement process.
We do not provide legal advice, tax advice, or investment advice. We are not attorneys. If you require legal counsel, you should consult a licensed attorney.
5. User Obligations
By using the Portal, you represent and warrant that:
- You are the rightful owner of the unclaimed property identified in your claim, or are legally authorized to act on behalf of the rightful owner.
- All information you provide is accurate, complete, and not misleading.
- You will not submit fraudulent claims or impersonate another person.
- You are at least 18 years of age.
Submission of false information may constitute fraud under applicable state and federal law and may result in civil or criminal liability.
6. Identity Verification
As part of the claims process, we are required to verify your identity. You consent to providing your full legal name, date of birth, and last four digits of your Social Security Number for this purpose. This information is used solely for identity verification and is handled in accordance with our Privacy Policy.
7. Electronic Signatures
By typing or drawing your signature in the Portal, you agree that your electronic signature is legally binding and has the same legal effect as a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the California Uniform Electronic Transactions Act (UETA).
8. Limitation of Liability
To the maximum extent permitted by applicable law, Ironclad Claims Division and Ironclad Equity & Assets Group, Inc. shall not be liable for:
- Any delays in the processing of your claim by the California State Controller's Office or any other government agency.
- Denial of your claim by the SCO or any other agency.
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Portal.
- Any loss or damage resulting from unauthorized access to your account due to your failure to maintain the security of your credentials.
Our total liability to you for any claim arising under these Terms shall not exceed the finder's fee paid by you to us.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in such courts.
10. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the effective date at the top of this page. Your continued use of the Portal following any modification constitutes your acceptance of the revised Terms.
